  1. Introduction
    1. By choosing to use the Site, you agree to abide by all the terms and conditions of these Terms of Use.
    2. Anetac may change these Terms of Use at any time, which shall become effective immediately upon posting. It is your responsibility to review these Terms of Use prior to use of the Site. By continuing to use this Site, you are assenting to any changes.
  2. Content on the Site
    1. The contents of the Site are for your personal, noncommercial, or internal business use. Information published on the Site (“Content”) is protected by copyright, trademark and other intellectual property rights and owned or controlled by Anetac or the provider of the Content. You shall abide by all legal restrictions and copyright notices in Content accessed through the Site.
    2. The Site may contain advertisements, links to third-party websites, resources, and materials (collectively, “Linked Content”). Anetac does not control, endorse, recommend or otherwise accept liability for any Linked Content. Anetac is not responsible for the availability of Linked Content, or their contents, services or privacy practices. Any concerns regarding Linked Content should be directed to the appropriate site.
  3. User-generated Content
    1. Any submissions you make to the Site (e.g., user-generated content including but not limited to form submissions, comments, forum messages, reviews, video, audio and photographs) (each, a “Submission”) may be removed, modified, published, transmitted, and/or displayed by Anetac.
    2. You shall not publish any advertising or solicitation for goods or services through the Site without the express approval of Anetac.
    3. You are solely responsible for the content of your Submissions to the Site. You shall not publish to the Site any libelous, defamatory, obscene, pornographic, abusive, harmful, threatening or otherwise illegal material. You will not disrupt discussions with repetitive or meaningless messages or “spam.” You will not use language that discriminates on the basis of race, religion, nationality, gender, sexual preference or orientation, age, religion, disability, or any protected class. You must be 13 years or older to submit data through the Site.
    4. You grant Anetac a perpetual, nonexclusive, world-wide, royalty free license to use, copy, publish, distribute, publicly display, publicly perform, create derivative works of, modify and adapt your Submissions in any form or media now known or hereinafter developed. You waive any rights you may have in having your Submissions altered or changed in a manner not agreeable to you.
  4. Security
    1. You shall not access any parts of the Site to which you are not authorized. You shall not alter or modify any part of the Site.
    2. The Site may contain registration or account creation capability, including login credentials by selecting a password and providing an e-mail address, name or other user identification. Each registration is for a single user only. You shall not share your login credentials or give your login credentials to anyone else. You are responsible for maintaining the confidentiality of your password. Please notify Anetac of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss or unauthorized disclosure of your login credentials.
    3. Violation of any of these Terms of Use is ground for immediate and permanent suspension of access to the Site.
  5. Representations and Warranties

    Anetac does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information displayed or distributed through the Site by any user, information provider or any other person or entity. You acknowledge that any reliance upon any such advice, opinion, statement or information shall be at your own risk. THE SITE IS AVAILABLE ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

    IN NO EVENT SHALL ANETAC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OF THE SITE, CONTENT OR LINKED CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ANETAC IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. IN THE EVENT THAT NOTWITHSTANDING THE FOREGOING, ANETAC IS FOUND LIABLE FOR DAMAGES OF ANY KIND IN CONNECTION WITH THE SITE AND/OR THESE TERMS OF USE, IN NO EVENT SHALL SUCH LIABILITY EXCEED A TOTAL OF $500.

    This Terms of Use is governed by the laws of the State of California (excluding its conflict of law rules) and the federal laws of the United States. The state and federal courts located in Santa Clara, California will be the exclusive jurisdiction for disputes arising out of or in connection with this Terms of Use.
